Pretty simple, really. If you didn't require "due process" to illegally enter the country, you won't need it to be removed. It doesn't take but a couple minutes to determine whether or not someone is legally authorized to be in the this country. Failing that, they should be summarily removed. That doesn't require a judge or a court date.
